Start an LLC by State

After you file an LLC (2026)

Approval is the middle of the job. Mainstay Filing, our best overall pick, also applies for the EIN and tracks the first report.

  1. Write the operating agreement. No state accepts it for filing; keep it with your records.
  2. Apply for an EIN. The IRS issues it free; form the LLC first.
  3. Skip the BOI report. FinCEN exempted U.S. companies (notice of August 11, 2026).
  4. Put the first report on the calendar. 6 states have none; the rest are due yearly or every two years.
  5. Open a bank account in the LLC’s name with the approved document.
